Terms of use

Short and plain. By creating or answering a form on Yawnkiller you agree to these terms.

1. Your forms, your responsibility

If you create a form, you are responsible for its content, for what you ask and for how you use the answers. That includes having a legal basis for collecting personal data and telling your respondents what you do with it. We store and process the answers on your behalf.

2. What is not allowed

• Phishing, or pretending to be someone you are not.
• Asking for passwords, PINs, full card numbers or other secrets. There is no password field on purpose.
• Illegal content, hate, harassment, malware, or anything that infringes someone else's rights.
• Spam, or using the service or the API to flood, scrape or attack anyone, including us.

3. We can take forms down

Anyone can report a form with the “Report abuse” link. We may disable or delete forms that break these terms or the law, without notice. Repeated or serious abuse gets reported to the authorities where required.

4. Your admin link is your key

There are no accounts. Whoever has the admin link of a form can edit it, read its answers and delete it. Keep it safe. We cannot recover lost admin links.

5. Free and Pro

The free plan comes with the limits shown on the pricing section. Pro is a one-time purchase, not a subscription. It is sold by Polar (polar.sh) as merchant of record, so Polar's terms of sale apply to the purchase itself and refunds are handled under Polar's refund policy. Pro includes the features listed at the time of purchase for the lifetime of the service.

6. The service is provided as is

We work hard to keep the service fast and online, but we provide it as is, without guarantees of availability or fitness for a particular purpose. Keep your own copy of anything important. We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are only liable for breaches of essential contractual obligations, limited to the typical, foreseeable damage. Mandatory statutory liability remains unaffected.

7. Changes

We may update these terms. The version on this page applies. For material changes that affect Pro customers we will give reasonable notice.

8. Law and contact

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence stay unaffected. Questions or reports: hello@yawnkiller.com, or see the imprint.
